Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Restless OS website and application (the “Service”), operated by Restless Industries LLC (“Restless OS,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Restless OS is a business software platform that helps businesses manage lead capture, customer communication, automations, payments, and related workflows, including connecting third-party accounts such as Instagram, Facebook, Stripe, and Google. Features may change, be added, or be removed over time.

2. Accounts

You must provide accurate information when creating an account and are responsible for keeping your login credentials secure and for all activity under your account. You must be at least 18 years old and authorized to act on behalf of the business you represent.

3. Connected platforms

When you connect a third-party account, you authorize Restless OS to access and act on that account on your behalf as needed to provide the Service. Your use of those platforms remains subject to each platform’s own terms and policies (including Meta’s and Stripe’s), and you are responsible for complying with them. You represent that you have the rights and permissions necessary for the accounts and content you connect.

4. Acceptable use

• Do not use the Service to send spam, unlawful, deceptive, harassing, or infringing content.
• Do not use the Service to violate the terms or policies of any connected platform.
• Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
• You are solely responsible for the messages, comments, and other content sent through your connected accounts using the Service.

5. Payments

Paid features are billed as described at the time of purchase. Payments are processed by our payment processor. Unless stated otherwise, fees are non-refundable except as required by law.

6. Intellectual property

The Service, including its software and content, is owned by Restless OS and its licensors and is protected by intellectual-property laws. You retain ownership of your own content. You grant us the limited rights needed to operate the Service for you.

7. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that automated actions or AI-generated content will be accurate or suitable for your purposes.

8. Limitation of liability

To the maximum extent permitted by law, Restless OS and Restless Industries LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the three months before the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users.

10. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in New York.

11. Changes

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
